S.F. No. 4524 Summary

• Modifies the definition of "qualifying medical condition" for the medical cannabis registry program by changing language from "any other medical condition or its treatment approved by the commissioner" to "any other medical condition or its treatment approved by a patient's health care practitioner" in Minnesota Statutes section 152.22, subdivision 14.

• Makes the same language change in Minnesota Statutes 2023 Supplement section 342.01, subdivision 63, replacing commissioner approval with patient's health care practitioner approval for other qualifying medical conditions.

• Removes the commissioner's independent authority to add, remove, or modify qualifying medical conditions under section 342.53, limiting the office to adding allowable forms of cannabinoid products only upon petition or legislative direction.

• Requires the commissioner and office to evaluate all petitions for adding or modifying qualifying medical conditions based on best available evidence and research, with notification to legislative committees by January 15 for changes effective August 1.

• Changes regulatory authority for determining qualifying medical conditions from state officials to individual health care practitioners' medical opinions.
