S.F. No. 4605 Summary

• Modifies the definition of "employee" under Minnesota's earned sick and safe time law (Minn. Stat. 181.9445, subd. 5) to include temporary and part-time employees who perform at least 80 hours of work per year for an employer in Minnesota.

• Adds four new categories of workers excluded from the employee definition: ambulance service personnel classified as paid on call or volunteer, firefighters classified as paid on call or volunteer, persons appointed to serve on governmental boards or commissions, and elected public officers or persons appointed to fill vacancies in elected offices.

• Retains existing exclusion for air carrier flight deck and cabin crew members who are subject to federal railway labor law, work less than a majority of hours in Minnesota annually, and receive paid leave equal to or exceeding statutory requirements.

• Makes the amendment effective retroactively from January 1, 2024.
