SF4662 Summary

• Prohibits child care center employees from being hired on condition that they have children eligible for or receiving child care assistance if the purpose is to obtain program funds.

• Prohibits applicants, participants, and providers from receiving or providing kickbacks or payments in exchange for obtaining child care assistance benefits, with exceptions for legitimate marketing, provider discounts, scholarships, and financial assistance.

• Creates new crime under Minnesota Statutes chapter 609.542 for intentionally offering or paying remuneration (kickbacks, bribes, rebates) to induce participation in federal health care programs, state behavioral health programs, or child care assistance programs.

• Creates corresponding crime for intentionally soliciting or receiving prohibited payments in exchange for applying for or receiving human services benefits.

• Establishes sentencing provisions under section 609.52, aggregation of values within six-month periods, and makes claims resulting from violations noncompensable and unenforceable; effective August 1, 2024.
