Commissioner of human services must implement a two-home and community-based services waiver program structure based on support needs rather than setting where the person lives.

Commissioner must implement an individualized budget methodology that is not based on residential setting and must increase waiver budgets at rates commensurate with disability waiver rate system increases.

Commissioner may seek all necessary federal authority to implement these changes and must ensure waiver services allow people to live in their own home, family home, or any community-based setting of choice.

Commissioner cannot implement waiver reimagine phase II until verifying that MnCHOICES 2.0 provides a clear standard for waiver service eligibility and is effective and culturally responsive, with an appeal rate not exceeding five percent.

Effective July 1, 2024, or 90 days after federal approval, whichever is later.
