Materials and supplies used in and equipment incorporated into construction of a new elementary school in Independent School District No. 2397, Le Sueur-Henderson are exempt from sales and use tax under Minnesota Statutes, chapter 297A.

Exemption applies to purchases made after May 31, 2023, and before January 1, 2025.

Tax must be imposed and collected normally, then refunded using the same process as projects under Minnesota Statutes, section 297A.75, subdivision 1, clause (17).

Refunds for eligible purchases cannot be issued until after June 30, 2024.

General fund appropriation to the commissioner of revenue covers the cost of refunds, effective retroactively for qualifying sales and purchases.
