Amends Minnesota Statutes 2022, section 245A.04, subdivision 9, regarding child care licensing variances.

Allows the commissioner to grant variances for a child care center's licensed capacity limit if the center's indoor space is within 100 square feet of what would be required for maximum enrollment based on staff number and qualifications.

Requires variance requests to be submitted to the commissioner in accordance with existing procedures and must include reasons for non-compliance and alternative equivalent measures.

Establishes that permanent variances expire as soon as conditions that warranted the variance are modified, and license holders must notify the commissioner of any changes or face revocation and potential sanctions.

Specifies that the commissioner's decision to grant or deny a variance request is final and not subject to appeal under chapter 14.
