School boards may renew an expiring capital projects referendum by board action without holding an election if the annual amount remains the same as the expiring referendum and the new term does not exceed the initial voter-approved term.

Board renewal requires a recorded vote and written resolution adopted after a public meeting where testimony on the renewal is allowed.

An expiring capital projects referendum can only be renewed by board action once; previous renewals by board action prohibit future renewals through this process.

The renewal resolution must be adopted by June 15 and becomes effective 60 days after adoption, with a copy submitted to the commissioner and county auditor by September 1.

School boards may renew an expiring referendum no more than two fiscal years before the referendum expires.
