S.F. No. 5399 Summary

• Undocumented noncitizens are ineligible for early supervised release, conditional medical or epidemic release, challenge incarceration program, earned incentive release credit, or any other program or credit that would reduce their term of imprisonment.

• The Commissioner of Corrections must not release undocumented offenders until they complete their full term of imprisonment and any disciplinary confinement periods imposed for rule violations or refusal to participate in required rehabilitative programs.

• Undocumented noncitizens are ineligible for sentence adjustment under Minnesota Statutes section 609.133.

• Both provisions take effect the day following final enactment.
