School districts may require a student against whom a restraining order or order for protection has been issued to receive instruction at a separate site for the duration of the restraining order or order for protection.

If the student is a child with a disability, the district must provide prior written notice to the parent or guardian and dispute resolution processes and procedural safeguards apply.

An alternate setting is defined as a school site in a separate building, which may include an area learning center, state-approved alternative program, or site under a service cooperative or intermediate school district.

The alternate setting must be selected to allow the student to progress toward meeting state academic standards and graduation requirements.

Placement in an alternate setting does not constitute a dismissal or other form of discipline.
