• Modifies adult foster care licensure to allow alternative overnight supervision methods when county licensing agency approves the plan and residents provide informed written consent, effective January 1, 2024.

• Permits use of monitoring technology for adult foster care and community residential settings to alert license holders of incidents without requiring on-site caregiver presence during normal sleeping hours.

• Establishes two response alternatives: Response Alternative (1) requires license holder on-site within 10 minutes of alert; Response Alternative (2) allows longer response times if interactive technology enables remote assessment and emergency dispatch procedures are in place.

• Requires license holders to develop and maintain policies addressing target populations, discharge procedures, technology backup systems, staff training, response protocols, and drills to ensure resident health, safety, and rights.

• Mandates informed consent forms explaining electronic monitoring use, privacy protections, risks and benefits, and confirms residents cannot be removed for refusing to consent to monitoring; creates new Minnesota Statute section 245D.261 for community residential settings remote overnight supervision requirements.
