S.F. No. 780 Summary

• Establishes rates for home-delivered meals under developmental disabilities waiver, brain injury waiver, community alternative care waiver, and community access for disability inclusion waiver equal to rates set under section 256S.215, subdivision 15, effective January 1, 2024.

• Increases nursing facility payment rates by $52 per resident day from July 1, 2023, through December 31, 2025, with facilities required to use additional revenue exclusively for employee compensation-related costs and submit distribution plans to the commissioner.

• Modifies definitions of dietary, housekeeping, laundry, and maintenance costs for nursing facility rate calculations by separating labor costs from non-labor costs and introducing a "known cost change factor" based on CPI-U index forecasts, effective January 1, 2025.

• Requires commissioner to update base wages for elderly waiver services annually on January 1 using Minneapolis-St. Paul-Bloomington MetroSA wage data from the Bureau of Labor Statistics, effective January 1, 2024.

• Requires elderly waiver rate framework providers to use at least 80 percent of marginal revenue increases for employee compensation-related costs and repeals the former elderly waiver rate setting methodology under section 256S.2101, effective January 1, 2024.
