Commissioner of Human Services must submit waiver amendments to federal CMS by December 1, 2025, allowing providers of individualized home supports (with training, without training, and with family training) to bill for indirect services provided without direct client contact

Indirect billing permitted when services ensure continuity of care, when reasonable attempts to involve the recipient have been made, when the recipient cannot participate due to illness/injury, or when the recipient has made an informed choice to allow services without direct contact

Billable indirect services include coordinating transportation and equipment, scheduling medical appointments, communicating with health professionals, arranging access to basic needs resources (shelter, food, phone/internet), and collaborating with employers

Additional billable activities include coordinating legal support, crisis prevention, positive support strategies, working with property management, meeting with interdisciplinary team members, and coordinating with other service providers during status changes or crises

Effective date is July 1, 2025
