Health carriers must reduce enrollees' prescription drug cost-sharing (deductibles and coinsurance) at the point of sale by 100 percent of all rebates received from manufacturers, pharmacies, or other parties

Rebates include negotiated price concessions, base price concessions, price protection rebates triggered by wholesale cost increases, and performance-based concessions that accrue to health carriers or their pharmacy benefit managers

Rebate information is protected as a trade secret and exempt from public records disclosure; health carriers cannot reveal actual rebate amounts by product, therapeutic class, manufacturer, or pharmacy

Health carriers must extend confidentiality requirements to any vendors or third parties that perform services on their behalf and have access to rebate information

Violations may result in civil penalties and suspension or revocation of the health carrier's or pharmacy benefit manager's license
