Long-term care facilities and assisted living facilities must allow at least one designated support person chosen by the resident to be physically present with the resident at all times

Designated support person includes any person chosen by the resident for comfort, such as a spouse, partner, family member, or other person related by affinity

Facilities may restrict or prohibit a designated support person only when strictly necessary to meet appropriate standard of care or when the person is acting violently or threateningly

Residents may file a complaint through the facility's internal grievance procedure if their designated support person is restricted or prohibited

Exemption applies to patients or residents at state-operated treatment programs
