Summary of Minnesota H.F. 3344: LGBTQIA2S+ and HIV Long-Term Care and Home Care Bill of Rights

• Establishes explicit nondiscrimination protections for residents of nursing homes, assisted living facilities, boarding care homes, and recipients of home care and community-based services based on sexual orientation, gender identity, gender expression, intersex status, two-spirit identity, and actual or perceived HIV status

• Requires mandatory LGBTQIA2S+ and HIV cultural competency training for all staff in long-term care facilities and home care providers, with 4 hours initial training for direct-care staff and 2-4 hours of ongoing training every two years covering terminology, health challenges, communication practices, and stigma-free care

• Creates specific resident rights including use of chosen names and pronouns, access to gender-affirming care, room assignments matching gender identity, use of restrooms consistent with gender identity, privacy protections for LGBTQIA2S+ and HIV status information, and freedom from isolation based on HIV status

• Prohibits arbitration provisions in home care and community-based services contracts and authorizes civil actions allowing individuals to recover damages, costs, and attorney fees for violations of these rights

• Imposes immediate fines of $1,000 per incident for substantial violations of these rights without requiring facilities to first correct the violation, and requires facilities to provide written nondiscrimination notices to all residents and clients
