Commissioner of Children, Youth, and Families must submit a federal demonstration waiver request to USDA by January 1, 2027, to prohibit purchasing candy, energy drinks, and soda with SNAP benefits

Candy is defined as products combining sugar or artificial sweeteners with chocolate, fruits, nuts, caramels, gummies, or hard candies in bar, drop, or piece form

Energy drinks are defined as beverages with at least 65 milligrams of caffeine per eight fluid ounces marketed for metabolic stimulation or energy enhancement, excluding coffee and tea products

Soda is defined as carbonated beverages with added sugar or artificial sweeteners, excluding plain/naturally flavored carbonated water, beverages over 50% fruit/vegetable juice, or those with less than 5 grams of added sugar
