Peace officers are prohibited from using tear gas in the performance of their duties, and law enforcement agencies cannot supply tear gas to or authorize its use by their officers

Law enforcement agencies and peace officers are banned from using chemical weapons and kinetic energy munitions (including rubber bullets, plastic rounds, and wax/wood/rubber-coated projectiles) on civilian populations

The POST Board must develop a model policy implementing these prohibitions by November 15, 2026, and distribute it to all chief law enforcement officers

Every state and local law enforcement agency must establish and enforce a written policy identical or substantially similar to the model policy by January 15, 2027

Exceptions are preserved for the National Guard and reserves to possess and use tear gas and electronic incapacitation devices in their official duties
