School district or charter school boards may opt out of all statewide assessments, including alternate assessments and English language proficiency assessments, for the 2025-2026 and 2026-2027 school years only.

The opt-out provision is specifically tied to the effects of federal Immigration and Customs Enforcement (ICE) activity on students, staff, and school communities.

Districts or charter schools that choose to opt out must notify the Commissioner of Education as soon as practicable of their decision.

The provision takes effect the day following final enactment of the bill.
