Individual authorized budget amounts for waiver services recipients cannot be reduced by more than 10% under Waiver Reimagine Phase II implementation unless a decrease in need is documented in the recipient's MnCHOICES assessment

Budget reduction limits are measured against the recipient's most recently approved authorized budget and documented needs from their MnCHOICES assessment prior to Phase II implementation

The 10% reduction cap continues to apply to all subsequent budget determinations as long as the recipient's documented needs remain the same or increase after Phase II implementation

Commissioner of Human Services must incorporate a cost-of-living adjustment for all waiver recipient individual authorized budgets into the Phase II methodology

These reduction limits and cost-of-living adjustments must be included in any proposed statutory language codifying the implementation of Waiver Reimagine Phase II
