Commissioner of Commerce must reimburse health plan companies for mandated health benefit costs when evaluations project a net increase in per-member, per-month costs for the nonpublic insured population

Payments apply to products offered in individual, small group, and large group insurance markets

Commissioner must issue payment within 60 days of receiving a statement from the health plan company

Cost calculations must follow the existing federal defrayal process under 45 CFR 155.170

Effective January 1, 2026, applying to all mandated health benefit proposals enacted after that date
