New assisted living facilities with six or fewer residents cannot be located within 650 feet of existing assisted living facilities or residential programs, unless granted a special use permit, certificate of need, or the existing program is in a hospital (effective July 1, 2026)

Commissioners of Health and Human Services may delegate inspection authority for small facilities (six or fewer residents) to county agencies and local governments, with inspections limited to every six months and violations reported within ten working days (effective January 1, 2027)

Municipalities must receive 30 days' written notice before licenses are issued for assisted living facilities with six or fewer residents and all residential programs licensed under Chapter 245A, including business name, address, license type, capacity, and contact information

Distance requirements for residential programs reduced from 1,320 feet to 650 feet from existing facilities, with exceptions available through special use permits or certificate of need approval

Lead investigative agencies must automatically notify reporters of vulnerable adult maltreatment cases within five business days of receiving reports, including case numbers and investigator contact information (previously required reporter to request notification)
