Sellers of emotional support dogs must provide written notice to buyers stating the dog lacks service dog training, does not have service dog legal rights, and that misrepresenting a service dog is a criminal violation under section 609.833.

Written notice must be in at least 12-point bold type and included on the purchase receipt or a separate document.

First-time violations for misrepresenting ownership or training of a service dog upgraded from petty misdemeanor to misdemeanor.

Second or subsequent violations for service dog misrepresentation constitute a gross misdemeanor.

Minnesota Attorney General authorized to enforce the emotional support dog notice requirements; criminal penalty changes effective August 1, 2026.
