Racing facilities (tracks, spectator areas, garages, and associated grounds for competitive vehicle and motorsport races) are granted immunity from nuisance lawsuits filed by surrounding property owners who purchased or built their property after the racing facility was established

Immunity applies to properties within a five-mile radius of the racing facility and remains in effect regardless of changes to the facility's size, scope, configuration, technology, or type of racing conducted

Local governments are prohibited from adopting or enforcing ordinances that would restrict, limit, or prohibit racing facility operations in a manner inconsistent with this immunity protection

Racing facilities must still comply with state and federal environmental laws and health and safety regulations

Effective August 1, 2026, applying to causes of action filed on or after that date
