Amends Minnesota Statutes section 260E.03, subdivision 15, which defines "neglect" in child welfare law

Adds new provision clarifying that a child with a mental, physical, or emotional condition is not considered neglected solely because they remain in an emergency department or hospital setting

Protects parents/guardians from neglect findings when necessary services (including residential treatment) deemed required by medical/mental health professionals or county case managers are unavailable

Applies specifically to situations where the child cannot be safely discharged to the family due to lack of available services, not parental unwillingness to provide care
