Requires local government approval before the Department of Transportation can acquire easements for road construction project elements that are not exclusively for motor vehicle travel (non-roadway project elements)

Local approval can be obtained through either a formal resolution by the city, county, or town governing body, or by majority vote at a general election

Applies to easements funded through sections 85.53 (state trails), 114D.50 (clean water), and 129D.17 when acquiring private or public land

"Roadway project elements" are defined as construction for exclusive motor vehicle use on trunk highways, including shoulders, ditches, and culverts—these would not require local approval

Effective July 1, 2025, for easements entered into on or after that date
