Local governmental units in the seven-county Twin Cities metro area (Anoka, Carver, Dakota, Hennepin, Ramsey, Scott, and Washington) may opt out of Metropolitan Council regulatory jurisdiction by filing a resolution with the Council, effective January 1 following the filing date.

Opted-out units become exempt from metropolitan system plans and requirements, and the Metropolitan Council is prohibited from levying most taxes on property within their boundaries.

The Metropolitan Council may continue to levy transit taxes on opted-out units within the metropolitan transit taxing district if transit services continue to be offered there, and may continue operating Council-owned property and transportation services in opted-out areas.

Opted-out local governments remain eligible to apply for Metropolitan Council grant programs and may enter into joint powers agreements with the Council.

Local units that opt out must wait at least four years before opting back in to Metropolitan Council regulatory jurisdiction by filing a new resolution.
