Unregistered persons purchasing hot mix or warm mix asphalt for commercial or retail paving, or falsely claiming contractor registration or personal use, commit a gross misdemeanor

Sellers face civil penalties up to $1,000 per violation, or up to $3,000 for knowing/intentional violations or repeat offenses, for selling to unregistered buyers without proper attestation

Personal use exemption allows purchases up to 5 tons per transaction and 10 tons per 12-month period with buyer attestation

Commercial or retail paving with hot mix or warm mix asphalt added to the definition of "building construction or improvement services" requiring contractor registration under section 326B.701

Effective date of August 1, 2027 for violations and crimes; sellers protected from civil liability when refusing sales based on these requirements
