Commissioner of Labor and Industry must adopt rules recognizing unvented attic and unvented enclosed rafter assemblies as compliant with Minnesota Residential Energy Code section R402

Assemblies must be insulated and air sealed with air impermeable insulation at R-30 (maximum U-Factor of 0.038) to qualify

Indoor heating, cooling, and ventilation equipment, including ductwork, must be located inside the unvented attic to meet the requirements

Amends Minnesota Statutes 2024, section 326B.106, subdivision 4, adding this as a new special requirement (subsection o) to the State Building Code
