City attorneys in Hennepin and Ramsey Counties may prosecute felony offenses and certain gross misdemeanor offenses when the county attorney declines to prosecute, provided the violation occurred within city boundaries and was discovered during a motor vehicle stop for an equipment violation.

City attorneys prosecuting these cases gain authority to issue administrative subpoenas for business records from telephone companies, utilities, hotels, pawn shops, transportation companies, financial institutions, and employers.

Coroners and medical examiners may conduct physical examinations and tests for city attorneys prosecuting cases under this authority, with the requesting city paying associated costs.

The law applies to crimes committed on or after the effective date, as well as prior crimes where the statute of limitations has not expired.

Effective the day following final enactment; amends Minnesota Statutes sections 388.051, 388.23, 390.251, and 484.87.
