Municipalities must hold at least two public hearings before approving any rezoning petition or conditional/special use permit for data center construction.

At least one hearing must be solely informational, with required disclosures posted 48 hours in advance including: petitioner name, anticipated end user, location and size, utility requirements (fuel, sewer, stormwater, electricity), and security guard details for sites near residential zones.

For data centers within or abutting residential areas, municipalities must disclose the estimated number of security guards and whether any will be armed with firearms or weapons.

Disclosure requirements override any nondisclosure agreements or contracts signed by the municipality or its agents.
