Racing facilities gain immunity from nuisance lawsuits brought by property owners who purchased or built their property after the racing facility was already established

"Racing facility" includes tracks, spectator areas, garages, and associated grounds where competitive vehicle and motorsport races are conducted

Immunity applies within a five-mile radius of the racing facility's property perimeter and remains in effect regardless of changes to facility size, configuration, technology, or type of racing

Local governments are preempted from adopting ordinances that restrict or prohibit racing facility operations in a manner inconsistent with this immunity

Racing facilities must still comply with state and federal environmental, health, and safety laws; effective August 1, 2026, for causes of action filed on or after that date
