Repeals and reenacts section 566.093, RSMo, defining sexual misconduct in the second degree to include exposing genitals likely to cause affront or alarm, having sexual contact in presence of others likely to cause affront or alarm, or having sexual intercourse in a public place in presence of a third person.

Establishes sexual misconduct in the second degree as a class B misdemeanor, or a class A misdemeanor if the offender has a prior conviction under the same chapter.

Elevates the offense to a class D felony if committed by a prisoner or offender in the presence of a minor or an employee or person assigned to work in any jail, prison, or correctional facility.
