Minors under 18 are prohibited from purchasing, attempting to purchase, or possessing cigarettes or tobacco products, with exceptions for employees in possession for work purposes and Division of Liquor Control enforcement agents.

First violation by a minor results in an infraction with confiscation of cigarettes or tobacco products; second and subsequent violations require an infraction, confiscation, and completion of a tobacco education or smoking cessation program if available.

Minors under 18 are prohibited from misrepresenting their age to purchase cigarettes or tobacco products.

Sellers of cigarettes or tobacco products face fines of $250 for a first violation and $500 for second and subsequent violations when an employee under 18 attempts to or effects a sale.
