Levies an excise tax of five cents per fluid ounce on beverages containing five or more milligrams of caffeine per ounce.

All revenue collected deposited into a new "Caffeinated Beverage Excise Tax Fund" to be used exclusively for health care coverage for uninsured children under Missouri's state children's health insurance program.

Director of the Department of Revenue shall issue stamps to sellers to indicate tax payment and prescribe reporting procedures.

Fund revenues do not revert to the general revenue fund at the end of each biennium and any investment earnings are credited back to the fund.

Measure subject to voter approval at an election held on the first Tuesday in August 2010 or at a special election called by the governor, becoming effective thirty days after majority voter approval.
