Repeals and reenacts Section 167.161, RSMo, regarding suspension or expulsion of students by school boards.

School boards may suspend or expel pupils for conduct prejudicial to good order and discipline, or immediately remove pupils who pose a threat of harm, provided prior disciplinary actions are not the sole basis for removal.

Parents or custodians may waive the right to a hearing before the board of education after meeting with the superintendent or designee to discuss expulsion.

School boards may suspend pupils charged with, convicted of, or who pled guilty to a felony criminal violation after providing notice and a hearing.

Student discipline hearings and proceedings relating to school participation are exempt from contested case hearing requirements under Chapter 536, provided appropriate due process procedures are observed, including the right to trial de novo in circuit court.
