Repeals and reenacts Section 577.010, RSMo, to modify the definition of driving while intoxicated to include operating a motor vehicle while any amount of controlled substance is present in the person's blood or urine.

Expands the crime of driving while intoxicated to apply when a person operates a motor vehicle in an intoxicated condition, while drugged, or while any measurable amount of controlled substance is detected in blood or urine.

Maintains that first offense driving while intoxicated is a class B misdemeanor with no suspended imposition of sentence unless the person is placed on probation for a minimum of two years.
