Repeals and replaces section 610.010 of Missouri's Revised Statutes relating to definitions used in the Open Meetings and Records Law (sections 610.010 to 610.030)

Adds new language to the definition of "public record" stating that a record shall not be considered created or maintained on behalf of a public governmental body if the body has no control over the record's creation or retention

Maintains existing definitions of closed meetings, public business, public governmental bodies, public meetings, and public votes in the Open Meetings and Records Law

Clarifies that records created by private contractors under agreement with a public governmental body are public records, unless the public body lacks control over the record's creation or retention

Preserves existing protections for student education records that may be inspected by parents, guardians, or custodians
