School districts may enter into design-build contracts as an alternative to existing procurement procedures, allowing architecture, engineering, and construction services to be furnished under a single contract.

School districts must establish written prequalification procedures and adopt rules governing contractor selection, the design criteria package, proposal evaluation, and contract award criteria based on best overall value (quality, technical skill, schedule, and cost).

School districts shall publicly advertise for design-build contractor qualifications in newspapers once weekly for two consecutive weeks and must receive at least two responsive prequalified submissions or readvertise the project.

Design-build contractors must obtain payment bonds under existing law and carry professional liability insurance for design services; all architects, engineers, and surveyors must be properly licensed in Missouri.

School districts must retain an independent architect or engineer to assist with project planning, design criteria package development, proposal evaluation, and contract administration; this independent professional cannot participate as part of the design-build contractor's team for the same project.
