Eliminates permanent partial disability claims against the second injury fund for injuries occurring on or after August 28, 2010, while maintaining the fund for permanent total disability and death cases.

Caps compromise settlements paid from the second injury fund at $60,000 beginning August 28, 2010, and limits director advances from the workers' compensation fund to 33⅓ percent of the annual surcharge with full reimbursement required within five years.

Establishes a nine-member Missouri State Workers' Compensation Council with voting members appointed by the governor, house speaker, and senate president pro tem to advise the division and submit annual recommendations on workers' compensation law amendments and second injury fund solvency.

Modifies the second injury fund surcharge calculation effective October 31, 2010, requiring the director to determine the surcharge percentage (up to 3 percent) to generate 110 percent of projected fund payouts less existing fund balance.

Adds requirements for health care providers to disclose financial interests in referred facilities, prohibits billing employees after proper notice of workers' compensation coverage, and allows employees to use accumulated paid leave for medical treatment during work time.
