Uninsured motorists (including uninsured owners, permissive drivers, and non-permissive drivers) waive their right to collect noneconomic losses from insured drivers who comply with financial responsibility laws in motor vehicle accidents where the insured driver is at fault.

Waiver does not apply if the accident was caused by a driver operating under the influence of drugs or alcohol, or convicted of involuntary manslaughter or second-degree assault.

Uninsured motorists whose previous insurance was terminated for non-payment are exempt from the waiver if the insurer provided notice of termination at least six months before the accident.

Any damages awarded to an uninsured motorist shall be reduced by the amount attributable to noneconomic losses, but the jury must not be informed of this waiver or its effect on recovery.

Passengers in uninsured vehicles are not subject to this recovery limitation, and the waiver does not prevent recovery for economic losses or benefits coverage.
