Changes the tax rate determination date for workers' compensation administration fees from December 31 to July 1, and the effective date of tax rates from January 1, 1994 to January 1, 2011.

Modifies the second injury fund surcharge calculation date from October 31, 2005 to October 31, 2010, with surcharge rates effective beginning January 1, 2011.

Adds a cap limiting advances from the workers' compensation fund to the second injury fund to no more than 33⅓ percent of the total annual surcharge, with repayment required within five years.

Establishes that surcharge collections shall be the sole funding source for the second injury fund.

Declares the repeal and reenactment of section 287.715 to be an emergency measure effective upon passage and approval.
