HB 2307 Summary

• Driveaway license plates may only be used by owners, corporate officers, or employees of the business to which the plate is issued, with applicants required to provide business information, proof of financial responsibility, and a photograph of their business building.

• Motor vehicle dealers financing or lines of credit cannot hold or preclude dealers from holding certificates of ownership; violators are guilty of class A misdemeanor (class D felony for repeat offenses).

• Dealers and public garages must retain vehicle records for five years (increased from three years) and false statements in monthly sales reports to the department are class A misdemeanors.

• Abandoned or uninhabited licensed dealership locations will have their licenses immediately revoked and all dealer license plates and temporary permits reverted to the department of revenue.

• Unlicensed sale of six or more motor vehicles in a calendar year is a class A misdemeanor, with second or subsequent convictions becoming class D felonies; prosecution for false statements on driver license applications extended to one year after discovery but no more than six years after the statement was made.
