HB 2362 - Agritourism Promotion Act

• Establishes the "Agritourism Promotion Act" allowing persons engaged in agritourism activities to register with the Missouri Department of Agriculture.

• Requires registered agritourism operators to post warning signage at their location and include warning language in written contracts, with letters at least one inch in height, informing participants that operators are not liable for injuries resulting from inherent risks of the activity.

• Limits liability of registered agritourism operators for participant injuries or death resulting from inherent risks, except when the operator acts with willful or wanton conduct or has actual knowledge of dangerous conditions or animal propensities that are not disclosed to participants.

• Establishes affirmative defenses in liability actions for operators when participants assume the risk, deliberately disregard safety warnings, or misuse equipment or animals.

• Creates the "Agritourism Fee Fund" with a registration fee not to exceed $100 per applicant to cover administrative costs; registrations are valid for two years and the department shall maintain and publicize a list of registered operators.
