• Repeals and reenacts section 260.205, RSMo, to regulate solid waste processing facilities and disposal areas through a permit system requiring construction and operating permits from the department.

• Requires applicants for solid waste disposal area permits to undergo preliminary site investigations, geologic and hydrologic investigations, and public involvement activities including community involvement sessions and public comment periods.

• Mandates the department establish minimum design, siting, operation, inspection, monitoring, financial assurance, and closure requirements for material recovery facilities, with different regulatory requirements based on waste streams processed and degree of automation.

• Prohibits permits for material recovery facilities from being issued until final regulations are effective, unless the facility processes only source-separated or single-stream residential, commercial, or industrial recycling wastes.

• Establishes permit application fees of $1,000 for processing facilities and $2,000 for disposal areas, with reimbursement requirements for department evaluation costs up to $4,000 and $8,000 respectively.
