Individuals convicted of felonies involving possession or use of controlled substances may be exempted from federal food stamp eligibility prohibitions if they meet specific conditions.

Exemption applies to those currently participating successfully in an approved substance abuse treatment program, or accepted for treatment with a waiting list.

Exemption applies to those who have completed an approved treatment program, are determined by a certified provider to not need treatment, or are complying with all court and probation obligations.

Department of Social Services must verify eligibility through documentary evidence, and applicants must meet all other food stamp program requirements.

Department of Social Services, in consultation with the Division of Alcohol and Drug Abuse, shall establish rules defining active participation and completion criteria for treatment programs.
