Submits to Missouri voters a constitutional amendment to Article I creating a new Section 35, called the "Missouri Energy Freedom Act," for approval at the general election on Tuesday following the first Monday in November 2010 or at a special election called by the governor.

Declares that states retain powers under the Tenth Amendment of the U.S. Constitution not expressly granted to the federal government, and that regulation of intrastate commerce is reserved to the states when not preempted by federal law.

Specifies that energy first produced by electric companies with facilities in Missouri shall be considered consumed by Missouri residents and not subject to federal laws or regulations until approved by the Missouri General Assembly and governor by law.
