Eliminates teacher tenure protections for all teachers hired on or after August 28, 2010, replacing the indefinite contract system with probationary, annual, and professional performance contracts.

Establishes three contract types: probationary contracts (one year, can be dismissed without cause), annual contracts (renewable at board discretion), and professional performance contracts (up to five years, renewable without cause after five annual contracts).

Creates new reporting requirements for the Department of Elementary and Secondary Education to track teacher effectiveness, publish information about first-time and temporary teachers by school, and monitor teachers with declining student performance.

Allows new teacher certification pathways including American Board for Certification of Teacher Excellence (ABCTE) certificates, Teach for America program graduates, and military instructors, with specific professional development requirements.

Implements performance-based evaluation system requiring appraisals based primarily on student learning gains, with 90-day improvement periods for unsatisfactory performance and allows teachers to appeal termination decisions to administrative law judges or school boards.
