Department of Social Services must develop a screening and testing program for TANF applicants and recipients when the department has reasonable cause to believe they use illegal controlled substances.

Applicants or recipients who test positive for unprescribed controlled substances are declared ineligible for TANF benefits for three years from the date of the administrative hearing decision.

Department must refer individuals who test positive to a substance abuse treatment program approved by the Division of Alcohol and Drug Abuse within the Department of Mental Health.

Department of Social Services shall promulgate rules to develop the screening and testing provisions, which must comply with chapter 536 requirements for rulemaking.

Rules created under this authority are invalid and void if any legislative powers to review, delay, or disapprove rules under chapter 536 are subsequently held unconstitutional.
