Adds section 208.247 to Missouri law to exempt individuals convicted of felonies involving controlled substance possession or use from the federal food stamp program prohibition under 21 U.S.C. Section 862a(a).

Individuals qualify for the exemption if they are currently participating in an approved substance abuse treatment program, accepted and waiting for treatment, have completed treatment, are determined not to need treatment by a certified provider, or are complying with court and probation/parole obligations.

Eligibility determinations must be supported by documentary or other evidence satisfactory to the Department of Social Services, and applicants must still meet all other food stamp program eligibility requirements.

The Department of Social Services, in consultation with the Division of Alcohol and Drug Abuse, must promulgate rules establishing criteria for determining active participation in and completion of substance abuse treatment programs.
