Governor's Council on Physical Fitness and Health shall develop the Missouri Healthy Workplace Recognition Program to recognize employers with more than 50 employees for excellence in promoting health, wellness, and prevention.

Minimum criteria for recognition shall include examination of whether employers offer workplace wellness programs, incentives for healthier lifestyles, opportunities for active community involvement and exercise, and encouragement of well visits with healthcare providers.

Five employers each year shall be designated as the healthiest place to work in Missouri, with designations posted on the state's Internet website and commemorated with a plaque.

Program shall automatically sunset six years after the effective date unless reauthorized by the general assembly, and if reauthorized, shall automatically sunset twelve years after reauthorization.

Any rules created under this section are subject to Chapter 536 rulemaking requirements and shall become invalid if the general assembly's rulemaking review powers are held unconstitutional.
